Ghost School By MoE Employee Siphons 11 Million Fraudulently
The Ethics and Anti-Corruption Commission (EACC) has secured a victory in a High Court case against Joshua Momanyi Ocharo, in pursuit of recovering over Ksh 11 million.
The EACC alleged that, while serving at the Ministry of Education, Ocharo established a fictitious school named ‘Mundeku Secondary School,’ supposedly located in Khwisero Sub-County, Kakamega County. He consistently allocated funds intended for the Free Day Secondary Education Programme to this non-existent school.
Momanyi, responsible for preparing Funds Distribution Schedules in the Ministry, included the fake school’s name in payment records and linked his own bank account to the ghost school, which he falsely represented as a legitimate recipient.

Justice Prof Nixon Sifuna, in his ruling, found that Momanyi had devised and executed a fraudulent scheme to obtain funds at the expense of Kenya’s children, who were the rightful beneficiaries of these funds.
EACC reported that the embezzlement occurred between August 22, 2017, and June 18, 2018. It was also revealed that Momanyi used a portion of the stolen funds to purchase a Toyota Vanguard and two parcels of land. The High Court has determined these assets to be illegal gains that should be confiscated by the government.
The prosecution recommendation file has been forwarded to the Office of the Director of Public Prosecutions (ODPP).
